How the hell is using TARMAC KERBS 'grass track' racing???

The WORMS are that if someone overtakes another driver and the use of kerbs is banned, the overtaker then uses the kerb as an alternative to hitting the driver who is squeezing him into the corner. The overtaker then gets penalised because he chose to use the kerb rather than hit the other driver. This kind of thing would then result in less overtaking as competitors will be nervous of overtaking and recieving a penalty (Just like it has become in F1)
