Look at your Blue Book. One of the duties of the CoC is to look at the driving performance of all drivers and can call any driver off the track at any time if he thinks the driving standard is not adequate to the occasion. There doesn't have to be an accident first.
Most CoCs are prepared to give novices the benefit of the doubt though and factor in race nerves and apprehension.
However, any faster driver lapping a novice ought to be aware that it is a novice, possibly on his first race and give the driver a wider berth, it may be the first time he has been overtaken for 'real'. Sometimes it's worth delaying the overtake just to be sure, though that's a difficult decision whne the pack is after you too.
