This requires detailed statistical record keeping. A club would have to justify a ban and I bet that any driver challenging the ban would find that clubs can't justify it and that they'd find 10 witnesses to say it was no worse driving than other drivers that were banned. (One Club (not karting) did ban a driver, was sued, took legal advice, was told by a QC they needed to record 30 different factors per driver to justify a ban (would require 2 people during race day), had breached non-discrimination clauses in both FIA SR codes and MSA rules. The driver is a mate and still drives at the club having been reinstated and was paid serious compensation in an out of court settlement.
The best thing that would equalise drivers would be to seal all engines and make sure they're equal.
