That has been a HUGE fear of car manufacturers for a while!
However, their argument was that it only INCREASES the safety by a margin, it doesn't make the car invinceable. But..... if a CUSTOMER could show that their ABS (for example) FAILED to 'engage' when it was reasonable to expect it to do so and THAT was the cause of an accident (a tough one to 'prove' in court).... then the car manuufacturer COULD be sued!
The profitablility of car companies means that it is poossible for them to insure against such claims.... the devices you are suggesting would not carry the SCALE of profitabilitry that could cover the anticipated claims or premiums.
However.... should YOUR 'device' fail and while the driver was being 'followed' by a Police car into a 30mph speed limit.... it wouldn't exactly require Rumpole to P*R*O*V*E that it was the failure of your device that ALLOWED the driver to gain 3/6/9/12 points on their licence!
Sadly, in our litigious world, a VERY large proportion of business time is spent considering these 'peculiar' situations.
